Immigration Through Employment and Family Sponsorship

Many people immigrate to America through sponsorships by close family members. Janice P. Warren, Toronto Immigration Lawyer, can help you get your "Green Card" if you have a close relative who is an American citizen or permanent resident.

How long the process takes may depend on many things, including:
  • The legal status of your family sponsor: Permanent residents are allowed to act as family sponsors for spouses and unmarried children. American citizens can also sponsor their parents.
  • Your relationship to your family sponsor: The closer your relationship to your sponsor, the more likely your reunion is to proceed smoothly and relatively quickly.
  • Your own status: Your ability to join your sponsor may depend on your age, marital status, criminal record, health and other factors.
The most common forms of immigration we see include:
  • Family sponsorships: Many of our clients want to join family in the States, or marry an American citizen. We can help you navigate this process and avoid complications.
  • Starting a U.S. business: If you have the financial means to do so, we can help you figure out how to make your move based on economic considerations.
  • Temporary employment: Many of our clients want to work in America, but intend to return to Canada. However, once they are in the U.S., many decide to remain, for work or personal reasons. We can discuss the steps necessary to turn your temporary status into permanent immigration.

If you are in Canada and you know that this move will be permanent, you must apply for a Green Card through consular processing by the U.S. Citizenship and Immigration Services. If you are in the U.S. when you realize that you want to remain permanently, you can file an Application to Register Permanent Residence or Adjust Status, in order to become a permanent resident.

​There are many different types of visas available to clients who want to move from Canada to the United States.

​Visa Types:
  • O visa — For people with extraordinary ability in the sciences, arts, education, business, athletics, motion picture and TV production, or people needed to assist those with extraordinary abilities
  • L visa — Used by people in managerial or executive positions, or people who have specialized knowledge, who need to transfer to a U.S. branch of an international company or help start up a U.S. branch of a Canadian company
 
  • TN visa — Intended for people in professions listed in the North American Free Trade Agreement (NAFTA)
  • E visa — For treaty traders, treaty investors and qualified employees of investors and traders
