Investor/Treaty Traders - 'E'-Visas
There are two ways to get into the United States through economic investment: as a Treaty Trader ('E-1' visa) or as a Treaty Investor ('E-2' visa). Janice P. Warren can help you decide which best fits your needs and is most likely to let you make the transfer successfully.
E-1 Visa (Treaty Trader)
Who You Are:
You may obtain an E-1 visa if you are an owner, manager, supervisor or employee with special qualifications in the company. The visa is valid for five years, but can generally be renewed for as long as you are needed to help your company continue its business in the United States
- must be able to show that you (or the company that employs you) carry on substantial or principal trade with the States.
- To qualify as "substantial," your company must carry out a continuous flow of international trade items over a period of time.
- To qualify as "principal" trade, you must be able to show that more than 50 per cent of the total volume of international trade of your company is with the United States.

E-2 Visa (Investor)
Who You Are:
The E-2 visa is for individuals willing to invest substantial amounts of capital in a U.S. business, or start up a new company in the United States.
America encourages foreign investing, however the investment must be substantial, and the purpose of the investor entering the United States must be to develop that investment. Janice can help explain the amounts of capital necessary and the types of investments that are considered likely to be beneficial to the United States.
Certain employees of a substantial investor may also qualify for an E-2 visa. These include executives, supervisors, managers or individuals with special qualifications in the field of the company that makes up the investment enterprise.
This visa is valid for five years, but may be renewed if necessary.

Our Toronto lawyer can find the best ways to make your move proceed efficiently and without complications. At our office, we facilitate moves for:
- Cross-border transfers: If you are an executive, manager or employee with special skills in an international company, you may be required to transfer to an American branch. You may also need to move to the States to open a new American branch of a business. We can help you obtain an 'L' visa for this purpose, and make your move happen without unexpected complications. Business acquisition and expansion can be particularly useful to business owners hoping to get a Green Card and eventually immigrate permanently.
- NAFTA professionals: If you are a qualified professional in a field such as engineering, medicine, law, accounting or teaching and you have a job offer from an American employer, you may be able to move to the States under a 'TN' visa.
- Investment or expansion into the United States.: If you are a business owner thinking of expanding your business to the U.S., or an investor hoping to invest in an existing American company or create a new enterprise in America, we can help you obtain an 'E' visa. These visas can require a considerable financial investment.
